By accepting these terms and conditions (including the linked information herein), and by using the Site, you represent that you agree to comply with these terms and conditions with Stone Mountain Farms (“we”, “us” or “Stone Mountain Farms”) in relation to your use of the Site (the “User Agreement”). This User Agreement is effective upon acceptance. If you do not agree to be bound by this User Agreement please do not access, register with or use this Site. Before you may become or continue as a member of the Site, you must read, agree with and accept this User Agreement and Stone Mountain Farms’ Privacy Policy (the “Privacy Policy”). You should read this User Agreement and the Privacy Policy and access and read all further linked information referred to in this User Agreement, as such information contains further terms and conditions that apply to you as a user of Stone Mountain Farms. Such linked information including but not limited to the Privacy Policy is hereby incorporated by reference into this User Agreement. We reserve the right to change and amend these terms and conditions. Any changes we make will be deemed to have come into effect on the date that they have been posted on the website. You are responsible for reading the terms and conditions. When you place an order with us you will be deemed to have read, understood and accepted these terms and conditions.

    Online shopping:

    Become a member on the site? In order for us to deliver to you, you will need to become a member of the Stone Mountain Farms website. All your details will be treated with the utmost privacy and security. Security is very important to us. We will require your delivery address, your contact and payment details. We will then give you an account number and ask you to set a password for your account. Please make sure your details are kept somewhere you can remember as this will help us to locate your account if you call or email us. Once your account has been set up, you’ll be able to view your order summary again in your ‘shopping cart’ page.

    Online orders:

    All orders submitted through our www.Stonemountainfarms.com website are confirmed by e-mail. No order should be deemed to be accepted without this confirmation. All orders are fulfilled subject to these terms and conditions. It might not be possible for us to accept orders for delivery to certain areas; in this case collection must be made from our stores or from a pre-arranged pick-up point. All orders are subject to availability. Should any of the items be out of stock at the time of placing your order, you will be notified via email and we will suggest an alternative if possible. Alternatively, you will be offered a refund for this item (see refunds and returns).

    Pick Up - Delivery:

    We offer Free Pick Up - Delivery at our MOBILE MARKET LOCATION during the Days and Times we are opened at these locations. 

    Payments and Refunds:

    We offer two methods of payment: Online payment through our secure payment gateway. You are now able to pay online for your purchases: we accept Debit and Credit Cards. In addition we accept EBT purchases by Checking Out C.O.D. (EBT Only) Option (See C.O.D. (EBT Only Orders).When you opt to make an online payment for your purchases, you will only be charged for the items which will be delivered. Upon confirmation of your order, you will receive a confirmation email with the items purchased. We will contact you to confirm a delivery time and date, as well as your final order (should there be any missing items). A final confirmation email will be sent to you with the final amount and confirmed items to be delivered. This is the amount that will be charged to your credit card. Any cancellations of orders paid for online need to be made in writing within 24 hours. Your card will then not be debited and the cancellation of the purchase will appear in your next bank statement. Terms and conditions will vary according to YOUR payment card.

    C.O.D. (EBT Only Orders):

    We can accept EBT for your Online Orders. When you go to Checkout, Select C.O.D. (EBT Only Orders) option for your Payment Method and we will bring your Order to the MOBILE MARKET LOCATION that you Select at the Date and Time you Select and we will process your EBT Order when you come to pick it up.

    Currency:

    Prices quoted are in USD and all payments are to be made in United States Dollars.

    Refunds, Returns and Stock Availability:

    Non-perishable items can be returned to Stone Mountain Farms within one week. We cannot offer refunds for fresh produce. Stone Mountain Farms we will work hard to only deliver the freshest and best products, and to keep the items on the website up to date. Due to the nature of Organic foods, and the fact that we work with small family suppliers, some items may no longer be available between the time of order and the time of delivery. Should a product no longer be available between the time of placing your order and the time of delivery, we will contact you by email to offer alternatives. Should you not wish to receive an alternative we will amend the order, and your receipt, prior to delivery.

    Other conditions:

    We will not be liable, in contract, tort (including, without limitation, negligence), pre-contract or other representations (other than fraudulent or negligent misrepresentations) or otherwise out of or in connection with the Conditions for: any economic losses (including without limitation loss of revenues, profits, contracts, business or anticipated savings); or any loss of goodwill or reputation; or any special or indirect or consequential losses; In any case whether or not such losses were within the contemplation of the parties at the date of the Conditions, suffered or incurred by that party arising out of or in connection with the provisions of any matter under the Conditions. Nothing in the Conditions shall exclude or limit our liability for death or personal injury resulting from our negligence or that of our servants, agents or employees. By using this website service, you agree to these terms and conditions of website use. Notwithstanding any other provision in the Conditions, nothing herein shall limit your rights as a consumer under US law.
